Trump's Framework of Punishment and Favor

Donald Trump's intense appetite for revenge has rapidly evolved into a structured framework. Over the twelve months, the chief executive's fury and caprices have adopted the guise of government actions in ways comparable to past repressive systems. Federal personnel who fail to comply are immediately removed and replaced by supporters. Opposing officials who confront him face indictment, court proceedings and penalties. Opponents have been designated under executive directives as “anti-American”, “against faith communities” and “anti-capitalist”, and warned with criminal charges as “extremists”.

The Justice System Transformed

Every instance involving legal action of political opponents and immunity for supporters demonstrates its own unique qualities. However, notwithstanding their particular character, they represent expressions of what has emerged as a deliberate method. These episodes are far from isolated. Trump's removal of DoJ lawyers and law enforcement personnel, coupled with his placement of supporters in key roles, commenced swiftly, promptly took on a regularity, and has now been molded into a regime. Federal prosecutors and the law enforcement agency have been transformed into political organizations under Trump's explicit orders to execute his wishes. Wrongdoing has been turned into normal. It represents the apparatus of revenge.

Administration is more concerned with targeting the leader's alleged opponents than they are with defending our public welfare.

Inside the System

The origin of this mechanism has been revealed in the court filing of multiple former top FBI agents filed in September in the federal court in DC against FBI director Kash Patel and justice department head Pam Bondi for illegal termination in “a initiative of revenge against them for what the accused judged to be a refusal to demonstrate sufficient devotion”. The document states that Brian Driscoll, the former temporary head, recounts a exchange in which he “freely confessed the impropriety of his behavior”.

The official had tried to defend FBI agents from being fired, the complaint alleges. He told him that “they” – interpreted by Driscoll to be the presidential administration and federal prosecutors – had ordered him to dismiss everyone who they considered as having participated in a criminal investigation against him. The filing adds: “He clarified that he had to fire the individuals his leaders told him to dismiss, because his ability to hold his own position was contingent on the removal of the officials who handled cases involving the leader. He explained that there was no way he or Driscoll could do to halt these or any other firings, because ‘the bureau attempted to incarcerate the President in jail and he hasn't forgotten it.’” After Driscoll advised him he was violating the agency's own regulations, he allegedly said “he understood that and he knew the essence of the immediate dismissals were probably illegal”.

Widespread Effects

Following the director's reported confession to Driscoll, the Department of Justice and the law enforcement agency have been weakened and reorganized for the administration's system of punishment. Multiple of the FBI's senior executives were dismissed or pushed out in the first days of the government. About thousands of professional attorneys at the justice department have taken a “voluntary departure plan”. No fewer than seven federal prosecutors, including those in the New York office, resigned in objection over what they viewed as ideological pressure in abandoning the corruption case against the New York City mayor, the mayor, in exchange for his collaboration with his federal agency arrests of migrants. The ethics division of the department, which handles ethical violations, has been diminished to two attorneys. The civil rights division has been devastated: the majority of its personnel has left. A third of senior leaders at the department have resigned. The unit implementing environmental law has lost half its management.

Favors and Sanctions

Concerning the legal matter, the interim prosecutor for the federal division, the official, resigned in protest against what she labeled as the “trade-off”. The border official, the president's “border czar,” appeared as the implementer with him on television to state: “Unless he complies, I'll reappear in New York City.”. And, another figure, previously the senior DoJ official and a ex-lawyer, who brokered the agreement, was awarded an appellate federal judgeship, a potential pathway to the supreme court.

The president's exemption for wrongdoings carried out while in power, provided by the unprecedented decision of the GOP-led on the supreme court, thus thwarting his prosecution over the political violence and preserving his electoral prospects for the 2024 election, is the foundation stone on which he relies to protect his stalwarts. Under these circumstances, he has been liberated to permit misconduct. The effect of the supreme court decision saturates his government and the political party down to its bones. The legal case has spread. In the words of a past leader's administration lawyer he remarked about the Watergate
